Dubai Legal and Dubai Courts Discuss the Development of Litigation Procedures in Government Claims before Relevant Judicial Bodies

As part of the strategic partnership between the two entities, the Government of Dubai Legal Affairs Department and Dubai Courts held a virtual meeting to explore ways to develop registration procedures and affidavit of service of government lawsuits initiated by the Department before the relevant courts, and discussed the latest updates to lawsuit registration in the smart systems and services of Dubai Courts, the relevant Departments responsible for monitoring those systems and services, and the challenges facing the two parties in this regard.

During the meeting, the two parties discussed various topics, including the importance of providing Dubai Courts with a list of government entities that may be represented by the Department, to avoid receiving notices falling outside the scope of its competence, especially because the tasks of the Department are limited to representing government entities or institutions in litigations either as plaintiff or defendant.  However, the competence of the Department does not include lawsuits filed against some government entities such as Endowment and Minors' Trust Foundation, and Public Prosecution for the presence of minors or interdicted persons, or lawsuits related to the work of the endowment administrators, because the Department is not authorized to represent them in this capacity.

The attendees from the Department hailed the importance of Resolution No. (1) of 2023 issued by the Dubai Courts to establish an administrative circuit in the courts of first instance to deal with all government claims in which the Government of Dubai or government entities are a necessary and proper party, which culminates in saving time and effort, and achieving speedy justice for its clients. In turn, the Dubai Courts team stated that two offices were created in the Appeal Case Management Department, and two circuits in the Court of Appeal to consider appeals filed against decisions rendered by the First Instance Administrative Circuit.

During the meeting, the parties explored ways of further coordination on procedures for serving notices on defendants in lawsuits filed by the Government and government entities, and the significance of including detailed addresses and Makani number in the statements of claim to facilitate the procedures of serving notices. The two sides also shed light on the challenges arising from the lack of such data which makes it more difficult to prove the last known domicile of the defendants, making it necessary to resort to investigation to complete the notice procedures.

The meeting was attended by Counsel Salah Jassim Bin Kalban, Senior Legal Counsel - Director of Government Disputes and Claims Directorate, Counsel Tarek Fayeq, Legal Counsel - Head of Government Claims Section, from the Government of Dubai Legal Affairs Department, and Mr. Adnan Al Hammadi, Head of Cases Management Department, Mr. Omar Mohamed Sharif, Head of Public Notice Division, Mr. Khaled Mohammed Al Shehhi, Head of Central Services Division, Mr. Jamal Abbas, Head of the Cassation Claims Preparation Division, Mrs. Sumaya Sultan Al Muhairi, Head Electronic Registration Section, Mr.  Ammar Saeed Al-Hashemi, Head of First Instance Cases Preparation Division, Mr.  Faisal Alzarooni, Head of Appeal Cases Preparation Division, in addition to other staff from both entities.
